The federal appeals court ruled on Tuesday that it would rehear the case concerning the president’s authority with an larger panel of eleven justices. The court also overturned a earlier ruling from a three-judge panel that had supported the administration.

Legal Saga Over Military Presence

This order represents the most recent development in a protracted legal battle over whether the former president has the legal right and justification to send national guard forces in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that federal officials at the ICE facility in south Portland were facing threats, while city and state officials maintain that local officers have control of the situation.

Contrary to descriptions of Portland as a conflict zone, residents have been sharing videos of lush hiking trails and a vibrant culinary culture, and planning events such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a US district judge in the city issued two legal injunctions this month – one preventing the federalization of the Oregon national guard, and another prohibiting the deployment of any military personnel in Oregon, after efforts to circumvent the initial injunction by calling up troops from California.

On the previous day, the appeals court had put the first ruling on hold – allowing command of 200 Oregon national guard – but the second ruling stayed effective, blocking the physical sending of the forces.

The Tuesday decision means the matter will be heard “en banc” – with both rulings under review simultaneously – by a group of eleven justices.

“This ruling shows that the truth matters and that the judicial system are striving to ensure government responsibility. The constitution restricts the executive authority, and local populations cannot be treated as a training ground for expansive government power,” said the legal representative in a statement.
