A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.
In her order, the court noted that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Context of the Case
The court proceedings center on conflicting assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in Tennessee.
Terms of Freedom
The judge, who was hearing his challenge to deportation in a Maryland district court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
This decision marks a notable turn in a complicated legal case featuring claims of mistaken imprisonment and contested gang associations.
